Protection of Economic Rights Through Royalty Optimization on Film Content in Digital Platforms

With the advent of video-on-demand (VoD) digital platforms, the distribution and marketing of films have shifted from conventional to digital methods which are more efficient and able to reach a wider audience. This transition also brings new challenges related to copyright protection and related rights, particularly regarding the distribution of royalties as an economic right. This research aims to contribute to the development of a fairer and more effective legal framework for protecting economic rights for creators and rights holders in the digital era. The method used in this research is normative juridical, involving an examination of primary legal materials. The research specification is carried out using descriptive analytical methods to analyze the positive laws that apply regarding royalties for the distribution and marketing of films via digital platforms. Based on the research conducted, the author found that currently there is no standard regarding the distribution system for royalties or profit bonuses received by copyright holders and related rights in the film industry, especially for works marketed via digital platforms. Hence, copyright and related rights holders are at risk of not receiving fair compensation for the use of their works. Therefore, it is necessary to develop a clear and comprehensive legal framework concerning the distribution of royalties in the film industry.
